Unnao rape case: CBI charges BJP MLA under Arms Act for falsely implicating victim’s father

This is the third charge sheet filed by the CBI in the case and the second against the MLA who was named as an accused in the rape case.

The Central Bureau of Investigation on Friday filed a charge sheet against BJP MLA Kuldeep Singh Sengar for falsely framing in an arms case the father of minor girl from Unnao who accused him of rape.

Nine others were named in the CBI charge sheet, including three policemen — then station officer of Makhi police station Ashok Bhaduria, sub-inspector Kamta Prasad Singh and constable Amir Khan.

The MLA's brother Atul Singh Sengar and their aides Shailendra Singh, Vineet Mishra, Birendra Singh, Ram Sharan Singh and Shashi Pratap Singh have also been named.

The MLA is accused of framing the minor's father in an Arms Act case in collusion with the local police.

The CBI had, on April 12, registered a case regarding the matter under criminal conspiracy and various sections of the Indian Penal Code — 166, 167, 193, 201, 218 — and Section 3/25 of the Arms Act.

The minor girl's father died during judicial custody in April allegedly of injuries suffered during an assault by the MLA’s brother and his aides. After the assault, he had been arrested by the Unnao police for the illegal possession of arms and sent to judicial custody based on a complaint from the MLA's side.

Third case filed by CBI

This is the third charge sheet filed by the CBI in the case and the second against the MLA who was, on Wednesday, named as an accused in the rape case. The legislator from Bangermau in Unnao faces charges under Sections 363 ( kidnapping), 366 (abducting and inducing a girl), 376 (punishment for rape) and 506 (criminal intimidation) of the Indian Penal Code and also relevant sections of the stringent POCSO pertaining to sexual assault.

The CBI on July 7 had named Kuldeep Sengar's brother Atul Sengar in the charge sheet in connection with the death of the minor's father. The other accused in the alleged murder case are Vineet Mishra, Birendra Singh alias Bauwa, Ram Sharan Singh alias Sonu and Shashi Pratap Singh, all residents of Sarai Thok Makhi in Unnao district. They face charges of murder and criminal intimidation, among others.

While the CBI did not name Kuldeep Sengar in the death case of the minor's father, it said it was investigating his role.

While being taken to a court here, Mr. Kuldeep Sengar told a television channel that he expected justice from the judiciary.

"I am being false implicated due to political reasons... I have full faith in God. I am innocent, so I am sure I will get justice," he said.
