Woman seeks custody of ‘raped girl’, fined

Petition was against the law, rules Mahila Court judge in Tiruvannamalai

The Mahila Court, Tiruvannamalai, has imposed a fine of ₹3,000 on a woman, who approached it seeking custody of a girl raped allegedly by her son. If she failed to pay the fine, she will have to undergo imprisonment for one month.

District judge G. Mahizhenthi, who holds additional charge as judge of the Mahila Court, observed that the petition filed by Ms. Krishnaveni was against laws, abused the process of law and amounted to wasting the court’s time.

The judge was referring to the recent Supreme Court judgment which said sex with a minor wife with or without her consent is rape.

Ms. Krishnaveni’s son Kalviarasan was charged with kidnapping a minor girl.

The girl was living with her grandmother after the death of her parents. Kalviarasan reportedly married the girl without knowing she was a minor.

As per a direction of the Madras High Court, the girl, who was three months pregnant then, was sent to a government home. She was delivered of a baby.

Following this, Ms. Krishnaveni approached the court petitioning that the girl had completed 18 years of age and sought the custody of the mother and child as she was her daughter-in-law.
