Leader of the Opposition in the Delhi Assembly Vijender Gupta on Wednesday said he had decided to approach the Delhi Lokayukta Court against Chief Minister Arvind Kejriwal for the appointment of 21 AAP MLAs as Parliamentary Secretaries (PSs).

Despite having “no authority” under Articles 102 (1), 191 (1) and Sec 15 of NCT of Delhi Act 1991, Mr. Gupta said that Mr. Kejriwal had “unconstitutionally and illegally appointed 21 Parliamentary Secretaries”.

“The CM also formally administered them the oath of office despite there being no such authority under the Constitution and NCT Act, 1991, got all of them allotted rooms in the Secretariat through the government in addition to official transport, allowances and other facilities at par with the Ministers,” Mr. Gupta said.

‘Punish Kejriwal too’

“Sooner or later, the Election Commission will reject their membership from the Delhi Assembly but Mr. Kejriwal should also be punished for unconstitutionally and illegally appointing PSs and administering them oath of office,” Mr. Gupta added.

The BJP leaders said that a petition against the appointments was filed before the Delhi High Court on June 19, 2015 for what he termed was the “unconstitutional, immoral and misconduct of the Chief Minister”.

“As he (Mr. Kejriwal) was aware that he has appointed these PSs illegally, he held a cabinet meeting on June 23, 2015 after the petition was filed to bring removal of disqualification of Legislative Assembly Members Amendment Bill 2015 to save his MLAs, who were appointed PSs, which the Honourable President received a complaint against,” the LoP said.

Mr. Gupta said that the only solution was to disqualify the 21 AAP MLAs.
