Delhi High Court refuses to stay notice asking Mahua Moitra to vacate government accommodation

Justice Girish Kathpalia said no specific rule has been brought before the court, which would deal with the eviction of members of Parliament from government accommodation after they cease to be MPs.

The Delhi High Court on Thursday rejected Trinamool Congress leader Mahua Moitra’s plea against a notice issued by the Directorate of Estates to vacate the allotted government bungalow here following her expulsion from the Lok Sabha over cash-for-query allegations.

In an order passed late in the evening, Justice Girish Kathpalia said the government accommodation was allotted to Ms. Moitra because of her status as a Member of Parliament. “...that status having ceased upon her expulsion, presently she has no right to continue in the said government accommodation,” Justice Kathpalia remarked.

The HC also noted that no specific rule was brought up by Ms. Moitra to deal with the eviction of MPs from the government accommodation after they cease to be the members.

In her fresh plea, Ms. Moitra had sought quashing a January 16, 2024, order by the Directorate of Estates directing her to immediately vacate the accommodation. She sought for allowing her to retain possession of her accommodation till the results of the 2024 general elections.
