HC stays order on monthly maintenance

Says proper reason was not given in Tenkasi RDO’s report

MADURAI

The Madurai Bench of the Madras High Court has stayed an order of the Tirunelveli Collector directing a man to pay monthly maintenance to his father, after the mother filed a plea against the direction.

The woman from Tirunelveli said following difference of opinion between the two they were living separately. She said her husband moved a lower court for divorce and obtained a decree in his favour, following which she and her son were living separately.

In the meanwhile, she said, their now grown up son was the sole earning member, working in Saudi Arabia.

While so, she said her husband filed a petition before the Revenue Divisional Officer of Tenkasi under Section 4 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, seeking a monthly compensation.

Considering the petition, the RDO submitted a report to the Collector to initiate necessary steps. The Collector directed the son to pay a monthly maintenance of ₹3,500 to his father. Challenging the order, the woman moved the High Court Bench.

Justice V. Bhavani Subbaroyan observed that the order passed by the authority was not proper and granted an interim stay. The court said no proper reason was given in the report and sought further details and adjourned the case till January 21.
