HC allows petitioner to be enrolled with Bar Council

The Madurai Bench of Madras High Court allowed a petitioner to be enrolled with the Bar Council of Tamil Nadu and Puducherry.

A Division Bench of Justices C.T. Selvam and A.M. Basheer Ahamed said that given the present day social fabric, many deserving candidates might be delayed or denied a right to enrol as advocates on false implications.

The Bench reiterated its earlier observation made while permitting documentary film-maker K. Divya to get enrolled with the Tamil Nadu Bar Council.

Petitioner Muthuesakki’s representation before the Bar Council was kept pending as a first information report was registered under Section 107 of the CrPC ( Security for keeping peace). The court said that Section 107 of the CrPC did not deal with any specific provision but informed of procedure to be followed towards avoiding commission of an offence.

The enrolment of the petitioner as an advocate could not be unjustly denied, the court said.
