A Delhi court has acquitted the husband and mother-in-law in a dowry death case, dismissing allegations levelled by the mother of the deceased woman.
“I find that none of the allegations made by the witnesses produced by the prosecution are found established so as to invite the assumption of guilt of the accused persons for alleged offences under Section 498-A (punishment for subjecting a woman to cruelty) or 304-B (dowry death) of IPC,” the court said, acquitting Satish and his mother Kamla in the case.
“There are no allegations at all in respect of any demand made by accused persons as consideration for the purpose of this marriage or in relation to the marriage between the parties, if made prior to the marriage.
“The allegations of post marriage period are not found to be reliable nor are they found to be connected with marriage between the parties,” the court further observed.
In these circumstances, there cannot be assumption of guilt of the accused persons for offence under Section 3 and 4 of Dowry Prohibition Act.
In view of my aforesaid observations and findings, both accused persons are acquitted of all the charges levelled against them, the court said in its 28-page judgment.
Satish’s wife had committed suicide at Khajuri Khas in North-East Delhi in 2011. The police had lodged the case on a direction by the SDM of the area.
The SDM had ordered legal action against the accused persons after the inquest proceedings and recording the statement of the deceased’s mother.
The mother alleged torture by the mother-son duo for dowry, but the court dismissed all allegations.
