‘Give papers on closure of probe to Najeeb’s mother’

Delhi court directs Central Bureau of Investigation; IO summoned on May 7

A Delhi court on Monday directed the Central Bureau of Investigation (CBI) to supply copies of statements and documents related to the closure of probe into disappearance of JNU student Najeeb Ahmed, to his mother.

Najeeb has been missing since October 15, 2016.

Chief Metropolitan Magistrate (CMM) Naveen Kumar Kashyap directed the probe agency to supply hard or soft copies of the documents and the statements to his mother within two weeks.

The CMM also asked the investigating officer of the case to be present before the court in person on May 7.

“There cannot be a half-hearted approach. In fact, an effective opportunity be given to the complainant to file protest petition. As such, whole of the cancellation report along with the statement of witnesses and documents, which are part and parcel of the present cancellation report, have to be supplied to the complainant. Accordingly, the CBI is directed to supply to the complainant all such statements of witnesses as well as documents as mentioned along with such closure report,” the CMM said.

The court also rejected submission by the CBI that there was no provision of protest petition and supply of documents to the complainant under the CrPC. “It is a settled law that in case of a closure report, complainant is to be given opportunity to file a protest petition, if so desired by the complainant,” the court said.

The court was hearing a protest petition filed by Najeeb’s mother, Fatima Nafees, against the CBI plea to close the case. Her counsel submitted that she had not been supplied the papers.
