Files on reserved subjects will be routed through us, reiterates govt.

The Delhi government on Tuesday reiterated its stand in favour of routing of files pertaining to reserved subjects of police, public order and land through the Chief Minister, while affirming that there was no scope for confrontation over the matter of jurisdiction in the light of the Transaction of Business Rules, 1993.

Clarifying its position in the wake of the recent transfer of 10 Joint Commissioners of Police, the Delhi government said the demarcation of jurisdiction for the Capital’s administration was settled with the clearly defined roles of the elected government and the Lieutenant-Governor.

The confusion arose apparently because the Delhi Police is under the direct control of the Union Home Ministry, unlike other States where police forces are controlled by the respective State governments. Sources in the Delhi government told The Hindu that no fresh orders for routing of files had been issued this week, as the position was already clear.

“Even if the L-G is empowered to reverse or strike down a decision of the Delhi government, the process for taking the decision has to involve the Chief Minister’s Office as the executive head of the government as per the law,” they added.
