At the Calcutta High Court to-day [January 8] Mr. Justice Greaves disposed of the suit brought by Mr. Aratoon George Paters against E.W. Montesole to recover Rs. 20,000 as damages for alleged libel. The plaintiff was a pensioner and the defendant a bookmaker. It was alleged that in connection with the Monsoon Race meetings held by the Royal Calcutta Turf Club on the 15th September last, Black water was running in Moderates Plate. An offer of six to one was announced on board. A gentleman offered a large sum for that bet, but subsequently the defendant denied that. A complaint was made to the Stewards and the plaintiff was pointed out as his witness. On that the defendant addressing the plaintiff said, ``Get away from here, you are a defaulter.’’ The defendant in his written statement admitted having used the expression but stated that he was privileged to use them. His Lordship held that the words were defamatory, but he did not think they were actionable without any special damage. The plaint did not disclose any cause of action, having regard to fact that no special damage was alleged. The suit was therefore dismissed.
