Representation makes allegations against judges

Taking a serious note of a representation containing certain allegations against the Judges of the Madras High Court, a Division Bench on Wednesday said it was prima facie of the opinion that the letter would amount to contempt of court.

The matter has been posted for November 15 for further hearing.

In its order, a Division Bench comprising Justices D.Murugesan and Vinod K.Sharma said it had received a copy of the representation dated November 2 sent by M.Aruchamy, president of the Association of Management of Private Colleges, and addressed to the Chief Justice of India (CJI.) The letter concerned the subject of writ petitions (a batch from minority educational institutions questioning the applicability of UGC regulations regarding the selection of Principal and other teachers in their institutions) which had been listed for hearing before the Bench. The representation made certain allegations against High Court Judges who had passed interim orders on earlier occasions. It requested the CJI to restrain the Madras High Court from passing any more interim orders/judgment in the case until the final disposal of the issues concerning larger interest. A further request had been made that the Supreme Court should transfer to itself all the petitions being heard by the High Court.

When the above representation was brought to the Bench's notice, counsel appearing for the parties namely R.Krishnamurthy, A.L.Somayaji, N.R.Chandran and Issac Mohanlal submitted that when the petitions were being heard, a representation of this sort would certainly amount to interference with the administration of justice.

In view of this submission, the Bench adjourned the matter.
