HC reserves order on Uber cab driver’s plea

The Delhi High Court on Wednesday reserved its order for March 4 on a petition of the cab driver facing prosecution in the December 5 Uber taxi rape case. The plea had sought recall of prosecution witnesses for their cross-examination in the trial court. The High Court asked the trial court not to pronounce its judgment till that date.

Justice Sunita Gupta of the High Court said that the verdict on the plea will be delivered on March 4. Petitioner’s counsel D.K. Mishra said there were several discrepancies in the case and the previous defence counsel had ignored them some crucial aspects.

Mr. Mishra, who had earlier sought recall of all the 28 prosecution witnesses, on Wednesday restricted the number to 13. He said these witnesses would include the victim of the crime as she had improved upon her statements. However, the Delhi Police counsel contended that allowing the petition would amount to a re-trial. He said the plea should have been made before the trial court and alleged that filing of the case in the High Court was a dilatory tactic.
