CAT upholds transfer of Rohini Sindhuri

Order for her new posting came in March

The Central Administrative Tribunal (CAT) on Tuesday dismissed an application filed by Hassan Deputy Commissioner Rohini Sindhuri Dasari, who had questioned the State government’s action of transferring her from the post within a short tenure of seven months allegedly for mala fide reasons.

“No actual mala fides have been brought out by the applicant to say that the transfer is against public interest. The right of the government servant in this regard is not to a posting to a particular place but to a post and perquisites attached to it. No government servant can ask for more unless and until actual mala fides are alleged and proved. Such being the case, we hold that there is no ground against which she can not be transferred,” observed a Bench comprising K.B. Suresh (judicial member) and P.K. Pradhan (administrative member) in its order.

Earlier posting

As the CAT had earlier allowed her to continue in the post of Hassan DC, now Ms. Sindhuri would be deemed to have taken charge of the new post to which she was transferred in March 2018. Another IAS officer, D. Randeep, who was transferred to her post, is deemed to have taken charge as Hassan DC with immediate effect.

CAT’s order

In its earlier order, the CAT had asked Ms. Sindhuri to submit a representation to the Chief Secretary against her transfer, and the High Court, on an appeal filed by her, had remanded the application back to the CAT asking the latter to adjudicate the matter while considering her contentions and the State government’s objections.
