The Kerala High Court on Friday directed the Central Government, Ernakulam District Collector and BPCL to file an affidavit in response to a writ petition alleging that over dimensional cargoes of Bharath Petroleum Corporation Limited are trying to be transported from the Warf of the Cochin Port Trust to the BPCL refinery at Ambalamedu through roads, violating the motor vehicle rules.

The petition was filed by T.S. Srijith, an advocate clerk. He pointed out that some over dimensional cargoes for BPCL were lying presently in Q7 warf of the CPT.

They were likely to be transported along the roads soon. Rule 93 of the Central Motor Vehicles rules had stipulated that the over dimensional cargos should not exceed the length of the carrier. The cargoes had a length of approximately 5 to 7 metres, which was more than the length of a carrier. The petitioner alleged that cargoes were going to be transported without securing sanction from the Centre and State governments as stipulated by the MV rules.

Besides, given the condition of the roads in the city, it would difficult to transport cargo by road.
