Justice A.V. Sesha Sai of the AP High Court on Tuesday posted a case filed seeking imposition of ban on All-India Majlis-e-Ittehadul Muslimeen (AIMIM) to a Division Bench.
The writ petition was filed by A. S. Rao, a resident of the city. The petitioner said the Central government should investigate into the political activities of the AIMIM and take action.
The Election Commission of India should deregister the AIMIM which, he claimed, was running with the sole ideology of Muslim democracy, protection of Muslim rights and nationalism and fanning communalism in the State.
He averred that the MIM leaders had often been involved in making controversial speeches, inciting violence, and spreading religious hatred. He referred to cases against MIM floor leader in Legislative Assembly Akbaruddin Owaisi who was accused and was standing trial for sedition, criminal conspiracy, spreading communal hatred and other serious charges. Its president Asaduddin Owaisi was charged with manhandling the Medak district Collector in 2005.
He told the court that the EC gave a reply stating that it had no power to deregister the MIM and aggrieved by the inaction of the authorities he (the petitioner) moved the court. Justice Sai said that larger issues of public importance arise and the case is in the nature of Public Interest Litigation and declared that it is appropriate that the case be heard by a Division Bench.
