Delhi court acquits two in ‘molestation’ case

A Delhi court has acquitted two persons in a molestation case stating that the incident “appears to be a case of road rage rather than a case where the modesty of the prosecutrix was outraged”.

Special Judge Hemani Malhotra acquitted Kamal Kumar and Ajay Kumar on an appeal filed by them against an order of a Magistrate court, which had sentenced them to two years’ in jail.

The judge said: “The version of the complainant establishes that she is not a credible witness and that the entire story of outraging her modesty was concocted by the prosecutrix, her husband and brother.”

The prosecution had said that the accused had allegedly molested the victim when she, her husband and brother were travelling in a van in central Delhi’s Karol Bagh in 2013.

In their defence, the accused admitted that an altercation had taken place with the occupants of the vehicle as they had hit their motorcycle from behind, but insisted that no incident of outraging her modesty had happened.

“There is not an iota of doubt that an altercation did take place between the parties... but it appears to be a case of road rage rather than a case where the modesty of the prosecutrix was outraged,” the court said.
