Court asks DDA to compensate builder

Observing that the “Delhi Development Authority (DDA) had constructed a public road on a private land not covered under acquisition proceedings,” a court here on Monday has asked the land-owning agency to pay compensation to the proprietor.

Additional District Judge Kamini Lau passed the order on a suit by Seema Builders, owner of the land, measuring 92 square yards at Gurmandi, Rajpur Chhawni, in North-West Delhi.

The plaintiff submitted that on September 3 2002, officials of the DDA along with police personnel illegally trespassed into the property and demolished his godown, shop, rooms and other portions falling in an area measuring about 92 square yards.

In its reply, the DDA said that the suit had been filed with mala fide intention to encroach upon the land. It also said that the company had given wrong particulars of the land.

However, the court dismissed the DDA’s argument.

“I direct the DDA to acquire the land of the plaintiff (proprietor) in accordance with law and to pay compensation to the plaintiff as per the prevalent market rate at the time of demolition with alternative plot as per the scheme, if any….,” the judge ordered.

The court also asked the DDA to pay damages of Rs. 2 lakh to the company.
