The Supreme Court on Thursday dismissed a special leave petition preferred against an order passed by the Madras High Court on May 23 quashing a criminal case pending against M.S. Jaffar Sait, Director General of Police, Crime Branch-Criminal Investigation Department (CB-CID) since 2011.
Chief Justice of India Ranjan Gogoi and Justice Deepak Gupta held that they did not find any merit in the special leave petition preferred by A. Shankar, the complainant in the case, especially when the High Court had quashed the case for want of sanction by the Centre to prosecute the Indian Police Service officer.
Justice P. Rajamanickam had quashed the case on the ground that the Union Home Ministry had refused to grant sanction for prosecution way back in 2013 and yet the case was kept pending by the trial court for nearly six years.
The case was related to alleged loss caused to Tamil Nadu Housing Board (TNHB) while allotting a residential plot allotted to the police officer’s wife. The Directorate of Vigilance and Anti-Corruption (DVAC) had booked the case. However, the IPS officer had refuted the allegation of having had any pecuniary advantage due to the purchase of the property and claimed that his family had, in fact, suffered a loss of ₹34 lakh due to payment of enhanced price for the plot which his wife was even willing to return to TNHB.
