High Court restrains bar on participation of CBSE students in sports events

The Madras High Court has granted an interim injunction restraining the authorities from preventing a CBSE student (petitioner) from participating in the sports events selection in Tamil Nadu State team conducted by the State Government authorities for school students.

Passing the interim order on the student's petition, Justice V. Dhanapalan admitted the petition and ordered notice returnable in six weeks.

In his petition, Minor B. Abinash of Adyar, represented by his mother, said by an order dated July 23, 2008 of the School Education Department, the participation of CBSE school students in the sports competitions held by the Department was cancelled from the academic year 2008-09. The petitioner challenged this order and the High Court while disposing off the petition in November last year, directed the government to frame a policy after consulting all the stakeholders by forming a committee comprising representatives from the State and the Centre.

Till such time the policy was spelt out, no CBSE student was to be prevented from participating in the various sports events conducted by the Tamil Nadu School Education Department. But, the petitioner said, the direction was not implemented. Instead the committee was formed in which no representative from the Centre was nominated. A resolution was passed on April 9 this year to prevent CBSE students from participating in the sports events.

The petitioner prayed the court to quash the April 9 order. He also sought an ad interim injunction restraining the authorities from preventing him from participating in the sports events.
