While the case relating to the assassination of the former Prime Minister Rajiv Gandhi before a designated court here will be pending, the court, by an order dated August 31, has said that the charges against the slain LTTE leader V. Prabakaran and his intelligence chief Pottu Amman have “abated.”
The two had earlier been declared absconding accused. The Multi-Disciplinary Monitoring Agency (MDMA) is conducting investigation and filing periodical reports before the court.
In his order, Designated Judge K.Dakshinamoorthy said the MDMA, New Delhi, filed an additional memo on August 30 stating that based on information collected from the Deputy High Commissioner of Colombo along with a communication from Sri Lankan authorities, it was satisfied that the two accused were dead.
The agency prayed the court to pass an order in the matter. It also made a specific request to permit it to carry on further investigation as against the other suspects.
The Judge said he was satisfied that the prosecution was able to prove that the absconding accused were no more.
Therefore, the charges became “abated.” Consequently, the case against the two absconding accused was being dropped.
