SC to take up CBI complaint on Wednesday

The Supreme Court on Tuesday refrained from ordering the personal appearance of West Bengal chief secretary, DGP and the Kolkata police commissioner in court on February 20 in connection with a contempt action initiated by the CBI against them.

A Bench led by Chief Justice of India Ranjan Gogoi instead said the matter would come up for consideration on February 20, when the CBI application is listed for hearing.

The CBI had moved the apex court against the State Police personnel who it said physically prevented the agency’s team from questioning Kolkata police commissioner at his residence on February 3 in connection with the chit fund scams. The CBI officers were detained in a police station for hours. The premier agency said the State had acted in contempt of the court’s orders, which had transferred the ponzi scam probe to the CBI from the State Police.

“We are not passing any order. We will take up this matter tomorrow [February 20],” Chief Justice Gogoi said.

The matter was listed for an order whether Chief Secretary Malay Kumar De, DGP Virendra Kumar and Kolkata Police Commissioner Rajeev Kumar would have to appear personally before the court on February 20 after a perusal of affidavits they filed on February 18.

The apex court on February 5 had issued contempt notice to the trio on the CBI’s allegations that they obstructed the agency and there was tampering with electronic evidence in the cases arising out of the Saradha chit fund scam.
