HC expunges remarks of lower court

T.P. Senkumar's handling of financial fraud case

The Kerala High Court on Monday expunged the remarks made by the Ernakulam Chief Judicial Magistrate Court against Additional Director-General of Police (Intelligence) T.P. Senkumar in connection with the handling of the LIS financial fraud case.

Justice N.K. Balakrishnan passed the order while setting aside the Ernakulam Chief Judicial Magistrate (CJM) court's order rejecting the plea of the prosecution to have a ‘further investigation' ordered into the case.

The CJM court had termed the intervention by the police officer in the case as dubious and observed that the officer and his aides were trying to scare the court. The CJM court had observed that it was unbecoming on part of Mr. Senkumar to comment on the progress of the case in which he was a witness. His conduct was likely to invite contempt of court proceedings, it had said.

Counsel for the officer K.R. Radhakrishnan Nair contended that the CJM court had made the comments without hearing him. In fact, he was not made a party to the proceedings. The observations of the lower court were unnecessary and irrelevant. It would adversely affect the career prospects of the officer and do irreparable injury to his reputation.
