SC dismisses appeal of ex-DGP in Kerala ‘fake encounter’ case

The Supreme Court on Wednesday dismissed the appeal filed by former Kerala DGP P. Vijayan, challenging his prosecution by the CBI in the alleged fake encounter killing of Naxalite leader Varghese in 1970.

A bench headed by Justice P Sathasivam, however, allowed 85-year-old Vijayan to move the special CBI judge court in Kerala for exemption from personal appearance during the trial. Vijayan had approached the apex court, challenging the framing of charges by the special CBI court on his alleged involvement in the killing of the Naxalite leader.

The CBI had earlier charge-sheeted the former DGP on the basis of the confessional statement made by police constable Ramachandran Nair, who confessed that he carried out the killing at the behest of his superior officers which included Vijayan, who was then DIG.
