Court directs woman to stay with her parents

It directs the married woman’s boyfriend to leave her alone

The Kalaburagi Bench of the High Court of Karnataka on Thursday disposed of a Habeas Corpus petition filed by Siddayya Swamy whose 24-year-old daughter and her three-year-old son were allegedly taken away by a relative Bandesh from Hosalli village of Yadgir district in June, and directed him to give custody of the woman to her parents.

A Division Bench comprising Justice K.N. Phaneendra and Justice B.M. Shyam Prasad passed the order and directed the woman to stay with her parents or her husband.

It also directed the police to see that Bandesh did not interfere with Pramila’s married life and stayed away from her. The court also instructed her parents to settle her marital life.

The police traced the call details and the mobile number and detained Bandesh and Pramila from Solan district in Himachal Pradesh and produced them before court as per its direction.

Pramila’s mother, Sharanamma Swamy, fell unconscious in the court hall after her daughter expressed her wish to stay with Bandesh and not to go with her parents or the in-laws.

Mr. Phaneendra explained to her that she cannot stay with another person without having a divorce first.

However, Pramila agreed to stay with her parents after her relatives convinced her to do so.

Pramila, a resident of Halakarta village in Yadgir, was living with her husband Tirthayya Swamy at Hosalli since 2014. On June 26, Pramila and her son Kedar went missing from the village. Her father Siddayya Swamy filed the Habeas Corpus Writ Petition before the High Court of Karnataka here seeking a direction to the police to produce his daughter and grandson before court.
