Controversial CD not doctored, say police

The Delhi Police have sought the closure of a case lodged by the former Union Law Minister, Shanti Bhushan, alleging that the compact disc said to contain conversations between him and Samajwadi Party chief Mulayam Singh Yadav and the former party general secretary, Amar Singh, was fabricated, stating that its contents were not doctored.

In a report submitted to a city court, the police said they based their conclusion on the findings given by the Central Forensic Science Laboratory (CFSL), Delhi, and the Indian Computer Emergency Response Team.

The case was registered after Mr. Bhushan lodged a complaint stating that a journalist from The Indian Express met him on April 13 and showed him a CD purportedly containing a recorded telephonic conversation between him, the Samajwadi Party chief and Mr. Amar Singh. The journalist told Mr. Bhushan that the CD had been delivered at the newspaper's office. Mr. Bhushan alleged that the CD was fabricated in order to malign him and that he never had any such conversation with the two political leaders.

In the report submitted in the court of Chief Metropolitan Magistrate Vinod Yadav, the police said that Mr. Amar Singh had recognised his part of the conversation with the Samajwadi Party chief recorded in the CD. Hence, they have sought the closure of the case stating that there is no substantial or corroborative evidence to establish the offence of forgery as alleged by Mr. Bhushan.

For his part, Mr. Bhushan's lawyer-son Prashant Bhushan said: “That goes to show that obviously someone very powerful in the government who could influence the Delhi Police has done this. The CFSL, Chandigarh, had found the CD fabricated. Truth Labs and George Papcun [United States] also concluded that it was doctored. In several places, [words spoken by] Mulayam Singh, which were part of conversations contained in a CD submitted by me in the Supreme Court five years ago in the Amar Singh phone-tapping case, had been cut and pasted on this CD.”

Mr. Prashant Bhushan said he had supplied to the police the reports of the Truth Labs and George Papcun, besides having submitted a CD to the Supreme Court. “It is yet another feeble attempt to smear,” he said, adding that attempts had also been made to create a divide between Team Anna members.
