A Division Bench of the Hyderabad High Court comprising Justice P.V. Sanjay Kumar and Justice M. Seetha Rama Murthy on Friday acquitted three persons who were given death penalty by a Guntur court for the alleged murder of an engineer in 2011. The failure of the prosecution in this case was pointed out.

Yekkaluri Siva Krishna alias Yogi, Akkinapalli Murali Krishna alias Murali, and Pappula Amar Nageswara Rao from Dachepalli were charged with murdering Banawath Badya Naik, who got into a taxi after visiting his son. The prosecution said these were professional dacoits who kill passengers for gain.

The Guntur court imposed death penalty and the present appeal was filed in High Court.

The Bench during the hearing found that there were no eyewitnesses and that two witnesses cited by the prosecution in the case came into the picture only after arrest of the accused.
