EC to hear parties on derecognition notices

The Election Commission (EC) on July 21 will hear the views of the Janata Dal (United), Samajwadi Party (SP), Trinamool Congress, Jharkhand Mukti Morcha (JMM), Marumalarchi Dravida Munnetra Kazhagam (MDMK), Pattali Makkal Katchi (PMK) and the Arunachal Congress, which have been given show cause notices for derecognition in some States due to their poor poll performance.

In the notices sent to them earlier they were asked to explain why their recognition in some States should not be withdrawn as they failed to fulfil the EC's conditions for being declared a State party. The personal hearing opportunity has been given to the parties on their request, sources said, adding that the final order would be passed after this.

Earlier this month, a similar opportunity was given to Rashtriya Janata Dal (RJD). Either the office-bearers of the parties or their legal counsel could appear for the hearing, sources added.

The Arunachal Congress, a recognised State party of Arunachal Pradesh, was given notice as it failed to fulfil the condition that all the candidates put up by the party should at least secure six per cent of total votes in the election.

For the RJD, the notice was given for failing to fulfil the conditions for a “national party” in view of its poor performance in the 2009 Jharkhand Assembly poll. Any party recognised in four or more States would be declared as a national party if it fulfilled the conditions in each State. The RJD is presently recognised in Bihar, Jharkhand, Manipur and Nagaland.

The JD(U), which is a recognised party in Bihar and Jharkhand, has been given notice in relation to its performance in Jharkhand. For the SP it would pertain to Madhya Pradesh and Uttarakhand, while it would continue as a State party in Uttar Pradesh. For the Trinamool Congress, the notice is for Meghalaya and it will continue as the State party in West Bengal and Arunachal Pradesh. For JMM it is for Orissa and it will continue to get recognition in Jharkhand.

The MDMK was given notice for not fulfilling recognition conditions in Tamil Nadu, and the PMK, for its performance in Puducherry, while it would continue to get recognition in Tamil Nadu.
