Bihar exam topper’s arrest comes in for flak

A day after the topper in the Bihar Intermediate exam, Ruby Rai, was arrested, strong reactions have come condemning the action.

“We had produced Ms. Rai before a judicial magistrate and she has been sent to Patna’s Beur jail for two weeks … now, she has to prove her being a juvenile and the court will take a decision on it,” Manu Maharaj, Patna Senior Superintendent of Police who heads the SIT of the result scam, told The Hindu. To a question, the SSP said, “The job of the police is to take action on the basis of complaint … the law takes its own course.”

Case filed

On June 7, a case against four “topper” students Ms. Ruby Rai, Saurabh Shresth, Rahul Kumar and Shalini Rai was lodged by an Education department official Rajeev Ranjan Prasad Singh with the Kotwali police station in Patna for “forgery and cheating.” “The case has been lodged against four students under Sections 420, 465, 467, 468, 471 and 120(B) of the IPC,” said Kotwali police official Ramesh Kumar Singh.

Ms. Ruby Rai, who was arrested on Saturday, was on Sunday produced before a judicial magistrate who remanded her for two weeks. The other three students have been absconding.

There were strong reactions against the arrest of Ms. Ruby Rai and charges levelled against three students. Union Minister of State for Human Resource Development Upendra Kushwaha condemned the arrest.

“Why should the students be arrested and sent to jail for the fault of the system, teachers and parents? ... if a student is not good at her studies it is their fault … they should not be penalised at all. Rather, the system be made accountable,” Mr. Kushwaha told journalists in Gopalgunj.
