NGT clearance to building project

The National Green Tribunal has issued a fresh order to the Kerala Coastal Zone Management Authority (KCZMA) to immediately grant Coastal Regulation Zone (CRZ) clearance to ‘Seashells,’ a flat constructed by the Pentagon Builders on the Kamburam beach.

The order came in favour of the builders as they challenged a stay order earlier issued by KCZMA in 2012 stating that the project was situated in CRZ-II area.

In the order, the NGT also endorsed the observation made by the Centre for Earth Science Studies that the construction activity of the appellant was very much permissible at the site.

Similar case

The NGT also considered a similar case from Kochi, where the KCZMA gave clearance to a residential apartment project without insisting much on the CRZ rules. The appellant argued that many of the major building projects were already permitted on the coastlines of Kozhikode. They could also convince the court that the main building of the city Corporation too was in CRZ-II area.
