Homebuyer’s plea for RO plant rejected

‘The facility was not part of construction agreement’

The Tamil Nadu Real Estate Regulatory Authority (TNRERA) has rejected a plea by a homebuyer for a reverse osmosis (RO) plant in a residential project by Real Value Promoters Pvt. Ltd., citing that the construction agreement with the developer indicates only a borewell or well will be provided for the basic fulfilment of groundwater needs, without any assurance for the quality and quantity.

In his petition, T.D. Dinesh Mohamed said he had booked a flat in the “Neelkamal” project at Kazhipattur village in Chengalpatu, Kancheepuram, developed by Real Value Promoters Pvt. Ltd. The agreement for the project promotion and construction between the complainant and the developer was made in 2011. The sale deed for the undivided share was executed last year. He had sought for completion and handing over of the apartment, with all committed amenities and compensation, on account of the delay from July 2013. Mr. Mohamed questioned the inability of the developer to provide a RO plant since he has ascertained that in the neighbourhood project area fresh water is available and if R.O. plant is installed it will be able to function satisfactorily.

The builder submitted that as per the laboratory report total dissolved solids stage of water in Kazhipattur village was very high and therefore the cost of operating a RO plant would be very high and hence not feasible.

The Authority ruled that Real Value Promoters would complete all committed amenities by November 2019 and shall hand over the flat before December 31. The buyer should take over the flat with all committed amenities except RO plant, it added.
