Civic body told to shift temporary shops from parking area

The High Court of Karnataka on Wednesday directed the BBMP to file an affidait giving a time frame to begin and complete the construction of the remaining blocks of the Jayanagar shopping complex, and to ensure smooth entry of vehicles to the parking area in the lower basement through the upper basement.

A Division Bench, comprising Chief Justice Abhay Shreeniwas Oka and Justice Mohammad Nawaz, issued the direction after the BBMP admitted that 42 shops were temporarily permitted in the upper basement, which is earmarked for parking of vehicles, till the new blocks are constructed.

It was pointed out to the Court that Bangalore Development Authority (BDA), which constructed the first block of the complex, accommodated these 42 shops, which were trading at the old blocks of the complex, to enable the demolition of the remaining old blocks to build new ones.

As BBMP Counsel said that the civic body has earmarked funds for building the remaining blocks but the tender for it is yet to be floated, the Bench said that the the BBMP has to give a time frame to complete building the new blocks and shift temporary shops in the upper basement.

The Bench orally observed that the area earmarked for marking cannot be utilised for any other purpose.
