State asked to compensate woman

The Madurai Bench of the Madras High Court directed the State to pay ₹50,000 to a woman, who was secured by three policewomen in violation of the provisions of the Code of Criminal Procedure (Cr.P.C.).

Justice G.K. Ilanthiraiyan took cognisance of the fact that the woman was arrested by the policewomen after sunset. . If any exceptional circumstances arose to arrest a woman after sunset, the woman police officer should make a written report and obtain permission from the Judicial Magistrate concerned to arrest her. This was not followed in the present case, the court said.

It was obligatory on the part of the State to ensure that there was no infringement of the rights of the citizen, the court said and ordered disciplinary proceedings against the police personnel.

The court was hearing the petition filed by S. Vijayalakshmi, in which she said she was arrested by Thilagar Thidal police in Madurai after sunset. It was said that when Vijayalakshmi and her relatives were engaged in a wordy duel, the police got a call at around 8 p.m. complaining of the duel. Subsequently, the policewomen secured Vijayalakshmi.
