HC disposes of petition on priority clause in reservation

The Madurai Bench of the Madras High Court on Friday disposed of a petition which sought to invoke a priority clause under the special category in reservation for wards of ex-servicemen in MBBS admission.

The petitioner, Jeya Sharmila of Madurai, sought reservation for her son Mothi Aniroudh in MBBS course under Priority III of the special category reserved for children of ex-servicemen. She said that her husband late M. Ramesh, a Havildar with the Indian Army, died in 2004, when her son was three years old.

Since her husband had died in service, her son should have been placed under Priority III for reservation in MBBS admission. But the petitioner claimed that wards of ex-servicemen were brought under a common pool in the special category. She claimed this was unfair and sought to invoke the priority clause.

Justice M. S. Ramesh disposed of the petition by observing that liability could be made out. However, the petitioner could approach the principal seat for relief, he said.
