Omission of IPS officers from CBI charge sheet

Seeking to review the Ernakulam Chief Judicial Magistrate’s decision accepting the CBI’s charge sheet that gave a clean chit to two IPS officers in the Sampath custodial murder case, the victim’s brother, Murugeshan, has filed a petition at the Principal Sessions Court here.

He has alleged that the CBI did not conduct proper probe into the involvement of both Muhammad Yasin, ADGP, and Vijay Sakhare, DIG, and purposely excluded them from the charge sheet. He also argued that no examination of the telephonic conversation of these officers was carried out.

In January this year, the Ernakulam CJM accepted a supplementary charge sheet filed by the CBI, which arraigned seven policemen as accused while giving a clean chit to the ADGP and the DIG. Accepting the charge sheet, the court observed that the investigation officer had carried out sufficient probe to arrive at the conclusion.

In the FIR, the CBI had arraigned 14 persons as accused and later added 18 others including the ADGP and the DIG, who were then given a clean chit.

The case pertains to the custodial death of Sampath, the first accused in the murder of Puthoor Sheela. Sampath was subjected to third-degree torture and died in police custody at a riverside cottage at Malampuzha on March 29, 2010.
