One of the four builders of Maradu illegal apartments has sought anticipatory bail in Ernakulam Principal Sessions Court as the Crime Branch investigation into the violations of law is progressing.
J. Paul Raj, director of Alfa Ventures, moved the court apprehending arrest. The court may consider the case on Tuesday.
In an affidavit submitted before the Supreme Court, the State government had assured to take action against the violators. The State had also asked the Director General of Police to take necessary legal action against the builders. It had undertook before the court to hold an inquiry and act against those who have facilitated the construction of the illegal buildings. The government was also planning to write to the Council of Architecture seeking action against the architects who designed the four buildings in violation of the extant Coastal Regulation Zone Rules.
Notice to builders
Meanwhile, the Balakrishnan Nair Committee on disbursement of compensation for Maradu apartment owners has decided to issue notice to the builders of the apartments asking them to file statements in two days showing the amounts received from flat owners.
The lawyers of Holy Faith Builders and Developers Pvt Ltd, which constructed the H2O Holy Faith, and Vichus Constructions and Hotels Pvt Limited, which constructed the apartment complex Golden Kayaloram, who appeared before the panel, undertook to file the statements on payments.
The committee, which ordered compensations to be paid to 14 apartment owners after inspecting the sale deeds, went by the amounts shown in the registered deeds for the first sale of the apartments while deciding on the compensation. The claim of some of the apartment owners that they “paid more amount than shown in the deeds” will be kept open for adjudication later, said a communication issued by the committee.
