Construction firm asked to compensate landowner

The Telangana State Consumer Disputes Redressal Commission directed a construction company to pay ₹50,000 as compensation to a landowner and give her a share of 45% in a penthouse, which was constructed keeping her in the dark.

The Commission was dealing with an appeal filed by A. Rama Devi, a septuagenarian, who had entered into a development agreement in connection with a plot of land at Manikonda which she owned, with the construction company S.V. Constructions.

Ms. Rama Devi was aggrieved at the order of the Consumer Disputes Redressal Forum Hyderabad-III and stated that the matter of her share in the penthouse was not taken into consideration. Taking cognisance of the evidence brought on record, the Commission noted that as per the development agreement, the share in the constructed complex to be given to the complainant is 45% and the rest is for the respondents. The Commission also noted that it was the complainant who had applied for regularisation of the penthouse and not the construction company. It stated that the complainant’s share was delivered well within the agreed framework.

While the Commission did not find merit in the complainant seeking ₹4.25 lakh as payment for delay in handing over possession, it did confirm the awarding of ₹50,000 compensation as ordered by the forum.
