Top court gives govt 10 days to decide on draft parking rules

Street parking fee to increase exponentially with duration

The Supreme Court on Friday asked the Delhi government to take a decision on the draft parking rules, which stress on the need to decongest Capital’s roads, within 10 days.

A Bench of Justice Arun Mishra and Justice Deepak Gupta gave the direction after the Delhi government submitted that the “Delhi Maintenance and Management of Parking Rules” were formulated and its draft was notified on January 24 last year.

In an affidavit filed before the top court, the city government said: “After considering the suggestions/objection received, the draft notification was further revised and proposal for obtaining approval of the competent authority for the issuance of notification of these Rules has been submitted to the Minister of Transport, Government of Delhi.”

As per the draft rules, an Apex Monitoring Committee, headed by the Delhi Chief Secretary, will determine the Base Parking Fee (BPF).

The draft rules says that surface parking will not be allowed within 500 metres of a multi-level parking lot for more than an hour.

It further said that the 500-metre radius of the multi-level parking facility will be designated a ‘no-parking’ zone for all streets.

To discourage street parking, the draft rules says that on-street parking fee will increase exponentially with duration to discourage long duration on-street parking.

The draft rules also says that parking will be allowed in demarcated areas on public streets and open surfaces in residential areas against parking charges to be decided by civic agencies.

It further said that in case of residential building, where stilt parking has been built as per bye-laws and yet such residents park their vehicles on public streets, the parking charges shall be twice the normal charges fixed for other residents.

Junk vehicles

Any junk vehicles of age more than 15 years for petrol and CNG vehicles and 10 years for diesel vehicles found parked on public streets will be impounded and released only on submission of proof of parking and undertaking that the vehicle would not be plied on roads in Delhi.

The apex court’s direction came while hearing a bunch of pleas relating to air pollution in Delhi-National Capital Region.
