Man gets 10-year RI for drug trafficking

A Delhi court has sentenced a man to 10-year rigorous imprisonment and imposed a fine of Rs. 1 lakh for bringing heroin from his village and selling it in the Capital.

The accused, Rehman alias Jiyaurehman, hails from Faridapur in Barreilly in Uttar Pardesh.

The Crime Branch of the Delhi Police had arrested him outside Lal Bahadur Shastri Hospital in East Delhi in 2010.

The raiding team had recovered 320 gram of heroin from his possession.

The forensic examination of the sample of the drug proved that it contained 9.91 per cent of diacetylmorphine.

On the disclosure by Rehman, the police had also arrested another accused Ajaybir alias Satbir, but he was later discharged by the court.

The prosecution examined 11 witnesses, all of them police personnel connected with the investigation.

Opposing the case, counsel for the accused submitted that the prosecution witnesses were confused as to who had issued the direction to take the parcels of the drug to the forensic laboratory.

But the court did not take it into account saying that with corroborative evidence of three witnesses, confusion in the mind of one of the witnesses who came to depose in the court after three years is ignorable.

Holding the accused guilty, Additional Sessions Judge Anuradha Shukla Bhardwaj said, “The accused has not been able to disprove the case of the prosecution on any of the issues raised by him. The accused is convicted under Section 21 (C) of the Narcotic Drugs and Psychotropic Substances Act.”
