A Delhi court has convicted a man for attempting to kill a labourer by tying him with a wooden plank and assaulting him with broken whiskey and beer bottles in east Delhi’s Shahdara in 2014.
The incident
According to the prosecution, the accused had attacked the victim late in the night when he was asleep on the footpath. The incident took place a few days after they quarrelled over alleged snatching of money from a rickshaw-puller by the victim. It was also admitted by the accused in his defence statement in the court. The injured and his brother had apprehended the accused and produced him before the police. However, the victim failed to identify the weapon of offence during the trial which the court ignored, saying that it was not fatal to the case.
The court also dismissed another argument by the defence counsel that opinion on the nature of the injuries was not taken.
Key evidence
The prosecution proved the case on the basis of eyewitnesses’ evidence by the complainant, his brother and another person and the medical report of the injuries.
“The complainant/injured had given a consistent statement on material aspects, which is duly corroborated by two other eyewitnesses and the evidence of witnesses of investigation and medical examination. The injuries were caused on the vital part of the complainant. In view of the above discussion, the prosecution has proved its case beyond shadow of reasonable doubt. Accordingly, accused is held guilty and convicted for the offences punishable under Section 307 (attempt to murder) IPC, ’’ Additional Sessions Judge S.K. Malhotra said in his judgment.
