The Uber rape victim’s father on Monday alleged traumatisation of his daughter by accused Shiv Kumar Yadav’s counsel in her re-cross examination.
Talking to journalists at Tis Hazari courts premises and later to The Hindu over telephone after his daughter’s cross-examination on the second day, he said: “My daughter is feeling traumatised due to irrelevant and unbelievable queries being put to her by the counsel for the accused.”
“The defence counsel is also resorting to delaying tactics by repeating questions already asked by phrasing them in a clever manner. My daughter also objected to the same in court,” the victim’s father added.
He was accompanying his daughter to the court of Additional Sessions Judge Kaveri Baweja, which is conducting the re-cross examination.
Yadav’s counsel D.K. Mishra told The Hindu on the phone that he wanted to wrap up the victim’s cross-examination as soon as possible and had filed an application in court seeking beginning of her cross-examination in the morning. He said if the proceeding was re-scheduled in the morning, her cross-examination will be over within three to four days.
Her cross-examination will continue on Tuesday.
A recent Delhi High Court order directed recall of 13 of the 28 prosecution witnesses, including the victim, for fresh cross-examination. The High Court had passed the order last week on a petition by the counsel for the accused. The counsel had challenged the trial court order dismissing the application of the accused seeking recall of all witnesses on the plea that the earlier defence counsel had not put suitable and sufficient questions to the prosecution witnesses. Mr. Mishra is Yadav’s new lawyer.
All prosecution witnesses, who have already recorded their evidence and been cross-examined by the defence counsel, have supported the prosecution’s case.
According to the police, the accused had allegedly sexually assaulted the victim on the night of December 5 last year in his cab, which she had hired to travel back to her home.
