A Delhi court on Friday convicted Utsav Bhasin, son of a Haryana businessman, in a BMW hit-and-run case in south Delhi in 2008.
However, Additional Sessions Judge Sanjeev Kumar acquitted him of the charge of culpable homicide not amounting to murder, saying that there was lack of evidence.
The witnesses did not support the charge of culpable homicide not amounting to murder against the accused, the Judge said.
The court held Bhasin guilty under Sections 304-A (causing death by rash and negligent act), 279 (driving rashly which could endanger human life) and 338 (causing grievous hurt) of the Indian Penal Code (IPC).
The accused had rammed his BMW into a motorcycle on the Moolchand flyover causing the death of the pillion rider, Anuj Singh, and injuries to journalist Mrighank Srivastava who was driving the bike.
Life cut short
The pillion rider was working as a freelance journalist as well as doing a course in graphic designing and animation.
The deceased’s father and brother were present in the court room when the judgement was pronounced.
The court later fixed May 26 as the date for hearing arguments on the quantum of sentence to be awarded.
The court has also asked the victim’s brother and father and Mrighank Srivastava to be present on the next date.
It asked the police to file a report on the economic conditions of the victim's family and the convict and his family.
