Consumer forum rejects complaint against SBI

‘Transactions done through Paytm’

A district consumer disputes redressal forum here has dismissed a complaint seeking compensation of over ₹59,000 from the State Bank of India. It was alleged that “illegal transactions” had taken place which led to the complainant losing close to ₹40,000.

However, the consumer panel dismissed the complaint stating that the transaction was done through PayTm that requires prior authorisation before a particular transaction is made.

“It is admitted that PayTm facilities or ATM cards remain in the custody of users. The password is only known to users. No transaction can be carried out by the user without using the Paytm facilities or ATM card along with the password which only he or she is privy to,” the consumer panel observed.

Stating that there was no evidence which proved that the complainant has never used Paytm, the panel added, “In the present case, the Paytm facility was in possession of the complainant and the password was only in his knowledge without which he could not have operated… The OTP logs show that the disputed transactions were successful.”

The consumer forum held, “The complainant has not placed on record any evidence which could show that the bank has committed deficiency in service.”
