The Supreme Court will hear this coming Monday a petition for a direction to the Central Bureau of Investigation to submit the entire status report of the investigation carried out in the sensational Aarushi Talwar-Hemraj twin murder case so far, and to further submit the monthly reports of the progress of investigation.
Advocate Ajay K. Agrawal in his petition filed in public interest also urged the Court to monitor the progress of investigation as the probe conducted so far had not unearthed the truth. A three-Judge Bench of Chief Justice K. G. Balakrishnan, Justice B. Sudershan Reddy and Justice P. Sathasivam fixed the date of hearing after Mr. Agrawal pleaded for an early listing of the matter.
The petition said: “The twin murder of Aarushi Talwar and Hemraj in Noida has become the biggest murder mystery of the country for the last about one and a half years and has been in the headlines of all national newspapers and electronic news channels and also it has got widespread coverage in foreign media. From the beginning there has been witch-hunting in which the relations between daughter and her father and between employer and servant have been in question. Subsequently the wide coverage of the case has led to a fear psychosis”.
Serious lapses
It pointed out that the case was transferred to the CBI in June last year and strangely in both investigations whether by the Noida police or the CBI there was no sufficient evidence resulting in non-filing of any charge sheet since the last 16 months of investigations.
There had been blunder in the investigations and very serious lapses and negligence, initially on the part of the police and later by the CBI.
The petitioner said the UP police in a hurry arrested the teenage victim’s father, Dr. Talwar, and booked him under Section 302 of IPC for murder of Aarushi and Hemraj.
No recovery
However, no material evidence or any recovery including the weapon of murder was made. “There seems to be gross negligence on part of the UP police as well as the CBI. No effective efforts were made to trace the missing mobile phones of victims Aarushi and Hemraj. If the Delhi police who has no role to play in this case is able to recover the mobile phone, whereas the country’s premier investigating agency investigating the most sensational murder failed to do so and earlier claimed that these mobiles were destroyed. Hence the present petition for a direction to the CBI to file a status report and for the Court to monitor the probe,” the petitioner said.
