The Delhi High Court on Friday made a man withdraw a petition seeking a direction to the Union Government to carry out amendments in the Hindu Marriage Act banning marriages within the same gotra.

The petitioner, Naresh Kadyan, withdrew his petition when a Vacation Bench of the Court comprising Justice S. N. Dhingra and Justice A. K. Pathak warned that it would impose a heavy cost on him if he persisted with his preposterous argument.

Later, the Bench dismissed the petition as withdrawn.

In his petitioner, Mr. Kadyan submitted that marriage within the same gotra was against Hindu traditions. He urged the Court to direct the Union Government to appoint a commission to suggest desired amendments to the Act.

However, when the Bench asked him to cite any Hindu scripture which bans marriage within the same gotra, the petitioner failed to quote any. Observing that the petitioner was wasting the precious time of the Court, the Bench said when he could not substantiate his submission he should not move a court.

The petitioner had moved the High Court after dismissal of his petition on the same matter earlier by the Supreme Court.

While dismissing his petition, the Supreme Court had asked him to move the High Court.
