The Delhi High Court on Tuesday reserved judgment on a petition by Congress leader Sajjan Kumar challenging a lower court order on framing of charges against him in a 1984 anti-Sikh riot case here.
Justice Vipin Sanghi reserved the judgment on conclusion of arguments by counsel for Sajjan Kumar and the Central Bureau of Investigation, the prosecuting agency.
Counsel for Sajjan Kumar challenged the lower court's order on the ground that the evidence of prosecution witnesses in the case was recorded very late and there were several discrepancies in their statements.
Counsel further submitted that the lower court had framed the charges against him without taking into consideration flaws in the prosecution's case.
Counsel for the CBI submitted that there were sufficient materials on record to send Sajjan Kumar up on trial. The agency justified the lower court's order for framing charges against him.
Sajjan Kumar is being prosecuted for charges of murder, dacoity and promoting enmity between two communities.
