The Delhi High Court on Wednesday granted five-hour custody parole to Vishal Yadav to attend the engagement ceremony of his sister on December 26.
Granting the parole, a Division Bench of the Court comprising Justice Anil Kumar and Justice Vipin Sanghi said that Vishal would attend the function from 5 p.m. to 10 p.m. under the custody of Delhi and UP police officials
The Bench will take up for hearing Vishal’s plea for interim bail to take part in the marriage ceremony of his sister on January 6.
Vishal, nephew of former Raya Sabha member D. P. Yadav, has sought interim bail to make arrangement for the marriage.
The petitioner submitted that his presence at the marriage ceremony was necessary as he was the eldest person in the family and was needed to make arrangements.
He also drew the attention of the Court to his “good conduct” when he was on bail for more than two years during the trial of the case as well as in jail while serving the sentence.
The High Court had in October allowed Vikas Yadav, another convict in the case, to attend the marriage ceremony of his sister, Bharti Yadav, “under judicial custody”.
A trial court had last year sentenced the two convicts to life imprisonment, holding them guilty of kidnapping and later killing Nitish Katara, son of an IAS officer here, in February 2002 because they were opposed to Bharti’s alleged affair with him.
The High Court is seized of their appeals against their conviction by the trial court.
