A Motor Accident Claims Tribunal has awarded a compensation of ₹57.27 lakh to the family of a businessman who was killed in a road accident in 2016.
The victim was hit by a three-wheeler while he was on his way to Indira Gandhi International Airport on a two-wheeler in the early hours on October 10, 2016. The driver of the autorickshaw had fled the spot.
The victim was immediately rushed to a hospital where he died after undergoing treatment for a few days.
Opposing the claim petition filed by the victim’s wife and others, the driver of the offending vehicle submitted that the petitioners had suppressed facts and that the accident had not taken place in the manner as described by them.
The insurance company with which the autorickshaw was insured, in its submission, said that no fresh damage was found on the offending vehicle. Rather, there was a fresh damage on the two-wheeler that implied that the autorickshaw was purposely implicated in this case for compensation.
Dismissing the driver’s contention, Presiding Officer Paramjit Singh said: “It is evident that deceased Neeraj Sharma sustained fatal injuries and died in a motor vehicle accident, dated 11.10.2016, due to rash or negligent driving of vehicle (TSR) no. DL 1RQ 6242, which was being driven and owned by Rajiv and insured with Shriram General Insurance Company Ltd. at the time of accident.”
The tribunal paid ₹57. 27 lakh to the petitioners with ₹56.56 under the head of loss of dependency to the family.
“The total loss of dependency to the family on account of death of the deceased Neeraj Sharma comes to ₹56,56,896 and as such, the petitioners shall be entitled to the said amount i.e ₹56,56,896 as compensation under the head of loss of dependency,” Mr. Singh said.
