A Delhi court on Monday reserved order on a plea to summon records from the Election Commission on alleged possession of two voter identity cards by BJP’s East Delhi Lok Sabha candidate Gautam Gambhir. Metropolitan magistrate Viplav Dabas reserved the order for May 13 on summoning the records as well as recording the statement of the complainant. AAP’s candidate Atishi Marlena has sought Mr. Gambhir’s disqualification from fighting the election for allegedly being a voter in two Assembly constituencies in the capital.
Locus standi
The court had on May 2 asked Atishi to prove her locus standi for filing the petition against her rival on the issue.
Mr. Dabas had directed the AAP leader to file more documents to prove her locus standi after her counsel said there was a prima facie case against Mr. Gambhir.
Advocate Karuna Nundy, appearing for Ms. Atishi, submitted that Mr. Gambhir was not eligible to vote and would be disqualified as a candidate.
The petition filed through advocate Mohhammad Irshad alleged that Mr. Gambhir had illegally enrolled himself as a voter in Karol Bagh and Rajinder Nagar Assembly segments.
