The All India Muslim Personal Law Board’s resolution that those men who pronounce triple talaq at one go will be socially boycotted will spell relief for women in the Muslim community (“Social boycott for triple talaq”, May 23). “Social quarantine” of such men will make them resort to course correction and I am sure that over a period, occurrences of triple talaq will slowly disappear. The AIMPLB also needs to explain how the Muslim community intends reforming itself when the fact is that many women affected by triple talaq continue to approach the judiciary for justice.

It appears that the AIMPLB has only agreed to send an “advisory” to all Qazis, a step that will never accord those affected statutory protection. The issue is about gender equality and the fundamental rights of women guaranteed under the Constitution. This will not be addressed unless the “divorce” issue is settled in a court and under a common code. In a male-dominated society, only a legal remedy will render justice to Muslim women. The argument that only a tiny fraction of Muslim marriages end in divorce does not hold water. If such statistical yardsticks are applied in the enforcement/enactment of rights/law, then no law will be enforceable. The Supreme Court should strike down the unconstitutional practice of talaq to ensure that no Muslim woman is subject to gender discrimination.
