Workplace must cover any place visited by law students, says intern

The law intern who has alleged that she was sexually harassed by Justice Swatanter Kumar in May 2011, when he was a Supreme Court judge, wants the scope of ‘workplace’ expanded to include not only the institution but also wherever the person worked along with the judge concerned.

In her writ petition, she said the definition must cover any place visited by the lawyer, law students or any other women during the course of work, including transportation provided by the court.

She challenged the constitutionality, legality and legitimacy of the December 5, 2013 Full Court Resolution that complaints against a former judge would not be entertained by the Supreme Court.

In public interest

The intern said she was filing the petition in the public interest so that there would be an acknowledgement of the truth of the sexual harassment she had suffered and a declaration that her fundamental rights had been violated.

She said such a declaration which acknowledged “the truth that sexual harassment has occurred even in high places will prevent other women being sexually harassed in the future.”
